According to the Czech Inspector-General of the Security Forces, officers did not commit a crime when kneeling on neck of man who later died

The Czech Inspector-General of the Security Forces (Generální inspekce bezpečnostních sborů - GIBS) does not at this time see the behavior of the police officers who intervened against Romani community member Stanislav Tomáš in Teplice on Saturday as rising to the level of a crime. The officers used force against the 46-year-old and handcuffed him while he was prone on the ground, immobilizing him by kneeling on his neck, among other things.  

Mr Tomáš died after the police intervention.. According to the preliminary results of an autopsy, police say he died of a drug overdose.   

The arrest was preceded by disorderly contact for which the police were called to the scene. They found Mr Tomáš already lying on the ground, and when police approached him, they say he responded by biting and scratching them. 

The officers used force to restrain and handcuff Mr Tomáš while he was prone on the ground. The restraint involved kneeling on him.

The European Court of Human Rights declared its decision on the case Memedov vs North Macedonia.

The court found violation of the articles 3 and 14. This is rare case of Romani applicant where the ECHR finds violation of the article 14 (prohibition of discrimination). The European Roma Rights Centre represented applicant before the court.

Damage

- The applicant claimed 24,000 euros (EUR) in respect of non‑pecuniary damage for mental and physical suffering as a result of the alleged violations.

- The Government contested this claim as excessive and invited the Court to award the applicant a lower amount if it did not find a violation on all alleged grounds.

- Ruling on an equitable basis, the Court awards the applicant EUR 3,000 in respect of non-pecuniary damage, plus any tax that may be chargeable.

Romanes, the language of the German Roma which I belong to, is a picture of our culture and identity. It paints out our reality, our dreams, hopes and fears. In the Romanes language, there is no word for war, no word for violence, but there are words for hunger, pain and love. According to that, there are lots of words for the police. Police brutality is omnipresent in our lives! The fear from persecution and destruction is constantly present, and it will only get worse if the Nazis once again are present in the Parliaments in the next months. Be loud! On Friday 25.06.2021, there will be a protest in front of the Czech Embassy in Berlin which will start from 16:00. Other cities such as Dusseldorf and Cologne, plan similar actions. Look for justice for Stanislav Toma and his family! For you and your families!

The MIA says that the problems have been surpassed – Spasovski: After the upgrade of the system, the personal documents will be issued with the Constitutional Name

The Minister for Interior Affairs Oliver Spasovski announced in the Parliament that in this moment, there is a migration of data to the newly upgraded system, which will start the issuing of all personal documents from Monday, the documents will be in accordance with the Constitution, in the part of the new constitutional name and with other legal data. He said that in the past period, there were problems in issuing personal documentation, but there is high demand for passports and said that there is only a problem in the issuing of diplomatic passports which for in this moments there aren’t neither new or old application forms.
